Farmer's Pride Wage & Hour Litigation

On February 23, 2007, this lawsuit was brought against Defendant Farmer's Pride, Inc. ("Farmer's Pride"), on behalf of all hourly production and support workers at Farmer's Pride, Inc.'s Fredericksburg, Pennsylvania poultry production facility during the three years preceding the date on which the complaint was filed. The suit was filed in the United States District Court, Eastern District of Pennsylvania. The named Plaintiffs in this lawsuit are Luz Lugo, Yesenia Marco, Carmen Torrez, Jessica Rosario, Vincente Rosario, Valentina Rodriguez, Wilma Cruz De Leon, Carmen Custodio, Juan Maldonado, Adelaida Naranjo, Giovani Caddle, Sussy Cisneros, Carmen Rivera, Wilfredo Blanco, Alcibiades Castillo, Lazaro Cabello, Amado Dipiton, Elsy Melgar, Demaris Perez, Lydia Perez, Gregorio Mota, Otacilio Vicente, Faridi Gomez Vargas, Jose Polanco, Elvira Gomez, Juan Maldanado, Milagros De La Cruz, Pedro Cruz De Leon, Cesar Serrano Alvarez, Luz Villa, Johnny Torres, Diana Cedeno, Edgardo Collaz, Seferina Caba, Raymond Garcia, Elliot Hernandez and Hassan Hargett.

This lawsuit alleges that hourly production and support workers at Farmer's Pride, Inc.'s Fredericksburg, Pennsylvania poultry processing facility: 1) failed to receive payment for all hours worked, including, without limitation, with respect to time spent putting on protective equipment and clothing at the beginning of the day, and removing and cleaning such equipment and clothing at the end of the day; and 2) failed to receive overtime compensation for hours worked in excess of forty (40) hours per week. Plaintiffs seek to recover payment for all hours worked and payment for unpaid overtime, including the interest thereon, statutory penalties, reasonable attorneys' fees and litigation costs on behalf of themselves and all similarly situated workers. The parties have agreed to issue notice of this lawsuit to all hourly production and support workers who worked at Farmer's Pride Inc.'s Fredericksburg, Pennsylvania poultry production facility at any point from February 23, 2004 to the present. Farmer's Pride, Inc. has denied all allegations in this lawsuit.
